3. Website Use

Our website is intended to provide customers with information about DAIDAI, its products, services, promotions, and ordering options.

By using our website, you agree to:

  1. Use the website only for lawful purposes.
  2. Provide accurate information when submitting inquiries or orders.
  3. Avoid interfering with website functionality or security.
  4. Refrain from unauthorized access to restricted systems.
  5. Respect the intellectual property rights of DAIDAI and third parties.
  6. Avoid submitting fraudulent, misleading, or abusive communications.

We may restrict access to website features when reasonably necessary to protect our business, customers, or website security.

4. Product Information and Availability

DAIDAI makes reasonable efforts to provide accurate descriptions, images, prices, and availability information. However, product details may change without immediate updates to our website or social media pages.

4.1 Food and Beverage Products

Food items may vary depending on:

  • Ingredient availability.
  • Seasonal menu changes.
  • Daily preparation quantities.
  • Kitchen operating conditions.
  • Special promotions.
  • Customer demand.

Photos and promotional images are provided for reference. Actual presentation, portion sizes, packaging, and appearance may vary.

4.2 Grocery and Retail Products

Grocery items, beauty products, fragrances, personal care products, and other merchandise are subject to stock availability. Certain products may be offered in limited quantities. Unless otherwise stated, products are available only while supplies last.

4.3 Product Accuracy

We make reasonable efforts to provide accurate product information. Where applicable, customers should refer to the manufacturer's original packaging for ingredients, allergens, usage instructions, warnings, expiration dates, and other product-specific information.

5. Pricing and Payment

Prices displayed on our website, menus, promotional materials, or social media pages are generally expressed in Japanese Yen (JPY), unless otherwise indicated.

5.1 Pricing Information

We aim to maintain accurate and updated pricing information. However, prices may differ depending on:

  • Promotional offers.
  • Product availability.
  • Ordering methods.
  • Third-party platform fees.
  • Delivery charges.
  • Applicable taxes.

The total amount payable will be communicated or displayed before an order is confirmed.

5.2 Pricing Errors

If an obvious pricing or listing error is discovered, we may contact the customer to clarify the correct price before accepting or fulfilling the order. Where an order has already been accepted, any correction, cancellation, or refund will be handled in accordance with applicable Japanese law and the circumstances of the transaction.

5.3 Payment Methods

Accepted payment methods may vary depending on whether purchases are made:

  • In-store.
  • Through direct arrangements with DAIDAI.
  • Through Uber Eats.
  • Through other supported payment or ordering channels.

Payments made through third-party platforms are subject to their applicable payment terms and procedures.

6. Orders and Reservations

Customers may inquire about products or place orders through available DAIDAI communication and ordering channels. These may include direct contact, Facebook Messenger, or Uber Eats.

6.1 Order Confirmation

Submitting an inquiry or order request does not automatically guarantee acceptance or availability. An order is considered confirmed when DAIDAI communicates its acceptance or when confirmation is issued through the applicable ordering platform.

6.2 Customer Responsibilities

Customers are responsible for providing accurate information, including:

  • Ordered items and quantities.
  • Contact information.
  • Requested pickup or delivery arrangements.
  • Special instructions.
  • Other details necessary to fulfill the order.

Incorrect or incomplete information may result in delays or difficulties fulfilling an order.

6.3 Special Orders and Preorders

Certain products, including party trays, food packages, and made-to-order items, may require advance notice. Any applicable preparation times, payment requirements, deadlines, or cancellation conditions will be communicated before the order is confirmed.

7. Pickup and Takeout Orders

Customers selecting pickup or takeout services are responsible for collecting their orders at the agreed time and location. Pickup times are estimates unless otherwise confirmed.

We recommend collecting prepared food promptly to maintain its quality and safety. Customers should verify their orders upon collection and notify DAIDAI promptly if there are missing or incorrect items.

If an order cannot be collected as arranged, customers should contact us as soon as possible. Any cancellation or refund will depend on the order's preparation status, applicable terms, and consumer protection requirements.

8. Uber Eats Ordering and Delivery

DAIDAI offers pickup and delivery services through Uber Eats where available. When customers place orders through Uber Eats, they are also subject to Uber's applicable terms, conditions, and policies.

8.1 Third-Party Ordering

Uber Eats independently operates its ordering platform and manages certain aspects of the customer transaction. These may include:

  • Order submission and confirmation.
  • Platform payments.
  • Delivery arrangements.
  • Delivery fees.
  • Customer account management.
  • Platform-based support.
  • Refund and cancellation procedures.

8.2 Restaurant Responsibilities

DAIDAI is responsible for preparing and providing ordered products in accordance with applicable food safety requirements and the accepted order details.

8.3 Delivery Services

Delivery times may vary depending on factors such as order preparation, courier availability, weather, traffic, and other circumstances. Delivery estimates displayed by Uber Eats are subject to the platform's procedures and conditions.

8.4 Order Issues

Customers experiencing issues with orders placed through Uber Eats should use the platform's designated support procedures. DAIDAI may assist with restaurant-related concerns where appropriate.

8.5 Uber Eats Terms

Customers are encouraged to review Uber's applicable terms before placing an order.

9. Cancellations, Returns, and Refunds

DAIDAI aims to address order concerns fairly and in accordance with applicable Japanese consumer protection laws.

9.1 Food Orders

Because food products may be freshly prepared or perishable, cancellation and refund eligibility may depend on the preparation status, nature of the product, and circumstances of the request. Customers should contact DAIDAI promptly if they wish to cancel or modify a direct order. Cancellation requests cannot always be accommodated after food preparation has begun. This does not limit any rights customers may have under applicable law, including rights relating to defective, incorrect, or nonconforming products.

9.2 Grocery and Retail Products

Returns or exchanges for grocery, beauty, personal care, and other retail products are subject to the applicable conditions communicated at the time of purchase and mandatory consumer protection requirements. For hygiene and safety reasons, certain opened or used products may not be eligible for discretionary returns. However, this does not exclude remedies required by law for defective or incorrectly supplied products.

9.3 Damaged or Incorrect Products

Customers who receive damaged, defective, or incorrect products should contact DAIDAI promptly and provide relevant order information. We will review the concern and determine an appropriate resolution in accordance with applicable law.

9.4 Third-Party Orders

Refunds and cancellations for Uber Eats transactions are also governed by the platform's applicable procedures. Customers may need to submit their requests directly through Uber Eats.

9.5 Statutory Rights

Nothing in these Terms excludes or limits consumer rights or remedies that cannot legally be excluded under Japanese law.

10. Food Safety and Allergens

DAIDAI takes food preparation and handling responsibilities seriously. However, customers should be aware that food products may contain ingredients associated with allergies or dietary restrictions.

These may include, but are not limited to:

  • Wheat and gluten-containing ingredients.
  • Soy.
  • Eggs.
  • Milk and dairy products.
  • Fish and shellfish.
  • Peanuts and tree nuts.
  • Other ingredients that may cause allergic reactions.

Customers with food allergies, dietary restrictions, or ingredient concerns should contact DAIDAI before placing an order. Although we take reasonable precautions, cross-contact between ingredients may occur in shared food preparation environments. We cannot guarantee that every product is completely free from a particular allergen unless expressly confirmed.

11. Retail, Beauty, and Personal Care Products

DAIDAI may offer selected beauty, fragrance, skincare, personal care, and other retail products. Customers are responsible for reviewing the manufacturer's instructions, ingredients, warnings, and recommended usage. Individual results and reactions may vary.

Customers should discontinue using a product if irritation or an adverse reaction occurs and seek appropriate professional advice when necessary.

Product names, trademarks, and brand identifiers belong to their respective owners. Unless expressly stated, the availability of branded merchandise at DAIDAI does not imply sponsorship, endorsement, or an official partnership with the brand owner.

12. Promotions and Special Offers

DAIDAI may offer promotional discounts, value meals, limited-time products, special packages, and other offers.

Promotions may be subject to:

  • Specific availability dates.
  • Limited stock.
  • Eligibility requirements.
  • Participating products.
  • Order limitations.
  • Additional terms disclosed with the promotion.

Promotional offers cannot necessarily be combined unless expressly stated.

We may modify or discontinue promotions prospectively, subject to applicable law and commitments already made to customers.

13. Facebook and Facebook Messenger

DAIDAI uses Facebook and Messenger to communicate with customers, share announcements, and respond to inquiries. Customers who interact with our Facebook Page or Messenger are also subject to Meta's applicable terms and policies.

13.1 Customer Communications

We aim to respond to inquiries within a reasonable period. However, response times may vary depending on operating hours, customer demand, and staff availability.

13.2 Public Comments

Customers are expected to communicate respectfully. We may moderate or report comments containing spam, harassment, fraudulent information, or other content that violates applicable platform policies or laws.

13.3 Third-Party Platform Responsibility

Facebook and Messenger are operated independently by Meta. DAIDAI does not control the availability, security, or functionality of Meta's services.

14. Google Business Profile and Google Maps

DAIDAI maintains a Google Business Profile to provide customers with information about our location, operating hours, contact details, and services. Customers may also access directions, reviews, and other information through Google Search and Google Maps.

14.1 Business Information

We make reasonable efforts to maintain accurate business information. However, customers should verify important details directly with DAIDAI when necessary, particularly during holidays, special events, or unexpected closures.

14.2 Reviews and Ratings

Customers may voluntarily submit reviews and ratings through Google. We welcome genuine customer feedback and may respond to reviews in accordance with Google's applicable policies.

14.3 Google Services

Google independently operates its search, maps, and business listing services. DAIDAI is not responsible for service interruptions or inaccuracies arising solely from Google's independent systems.

17. Third-Party Websites and Services

Our website may contain links or integrations involving external platforms, including:

  • Facebook.
  • Facebook Messenger.
  • Uber Eats.
  • Google Business Profile.
  • Google Maps.

These platforms are independently operated and maintain their own terms, privacy policies, and service conditions. DAIDAI is not responsible for the independent operation of third-party websites or services.

However, nothing in this section excludes responsibilities that DAIDAI may have under applicable law.

18. Privacy and Personal Information

Your privacy is important to DAIDAI. Personal information collected through our website and business operations is handled in accordance with our separate Privacy Policy.

Our Privacy Policy explains:

  • What personal information we collect.
  • How information is used.
  • When information may be shared.
  • How information is protected.
  • Your applicable privacy rights.
  • How third-party services process personal information.

Please review our website's Privacy Policy for further information.

19. Service Availability and Interruptions

  • Operational requirements.
  • Supply shortages.
  • Severe weather.
  • Emerencies.
  • Circumstances beyond our reasonable control.

We will make reasonable efforts to minimize disruption when practicable.

Any liability arising from interruptions will be determined in accordance with applicable law.

20. Limitation of Liability

DAIDAI is responsible for its obligations to customers as required by applicable Japanese law. To the extent permitted by law, we are not responsible for losses arising solely from circumstances outside our reasonable control or from the independent acts of third-party service providers.

Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, or any other liability that cannot lawfully be excluded or limited.

In particular, these Terms do not restrict mandatory consumer rights under Japan's Consumer Contract Act or other applicable laws.

  • Website functionality.
  • Business operations.
  • Products and services.
  • Ordering procedures.

Revised Terms will be published on our website with an updated effective date.

Changes will apply prospectively, subject to applicable law and any contractual obligations already established.

These Terms are governed by the laws of Japan.

In the event of a dispute, customers are encouraged to contact DAIDAI first so that we may attempt to resolve the matter through communication. If a dispute cannot be resolved, it may be referred to a court having jurisdiction under applicable Japanese law.
